Burkina Faso: Loi No. 030-2008/AN portant lutte contre le VIH/SIDA et protection des droits des personnes vivant avec le VIH/SIDA

Texte de loi relative au VIH. Articles pertinents prévoyant des sanctions pénales : Article 20 (rapports sexuels non protégés avec un partenaire non informé du statut sérologique); article 22 (transmettre volontairement des substances infectées par le VIH); article 26 (omission de prendre les précautions nécessaires pour protéger le partenaire). La loi prévoit aussi une obligation de divulguer sa séropositivité (article 7) et de s’abstenir d’avoir des rapports sexuels non protégés (article 10).

On appeal, the Consitutional Court of Zimbabwe decided the only defence to prosecution is disclosure of known or potential HIV infection and suggested people with HIV can be discriminated against by the law if the reason is to protect public health.

Describes creation of a working group facilitating dialogue between the justice and public health authorities on the issue of criminalization. The working group called on the Justice Ministry to develop prosecutorial policies and guidelines. Governmental health authorities proved to be key allies in opening a dialogue with the Justice Ministry. Suggests that health authorities should play a central role in the development of prosecutorial policies and guidelines.
