Enforcement of HIV Criminalisation in Ohio – Analysis of court cases from 2014 to 2020

Equality Ohio Education Fund (EOEF) and the Ohio Health Modernization Movement (OHMM) collaborated for over three years to for the first time gather data across all 88 counties in Ohio about the use of HIV Criminalisation laws and the consequences of HIV criminalization across Ohio. This effort, which is the first of its kind in Ohio, catalogs the criminal cases charged in Ohio from 2014-2020 under any of Ohio’s six statutes that criminalize or create penalty enhancements for people living with HIV.

Role of viral suppression in HIV treatment and prevention and its potential in addressing harmful laws and discrimination

This article documents key moments in research and WHO policies that have informed how ART is applied within HIV programs, including as a prevention tool with the potential to support efforts to address HIV-related discrimination. In 2023, WHO continues to clarify that there is zero risk of sexual HIV transmission when a person living with HIV has an undetectable viral load and an almost zero or negligible risk of sexual transmission when a person living with HIV has a viral load of ≤1000 copies/mL.

В данной публикации мы рассмотрим уголовное преследование за грудное вскармливание в контексте актуальных медицинских рекомендаций и культурных установок в отношении грудного вскармливания. Мы расскажем об уголовных делах, возбужденных против женщин, живущих с ВИЧ, за грудное вскармливание в разных странах мира, и о критериях обоснованного уголовного преследования. И, наконец, нами будут предложены рекомендации по достижению прогресса на пути декриминализации и устранения барьеров в доступе к профилактике, лечению и уходу в связи с ВИЧ.

Positive sexuality: HIV disclosure, gender, violence and the law—A qualitative study

Drawing on a feminist analytical framework and concepts of structural violence, this analysis sought to characterize the negotiation of sexual relationships and HIV disclosure among Women Living with HIV (WLWH) in a criminalized setting. Researchers conducted 64 qualitative interviews with cis and trans WLWH in Vancouver, Canada between 2015 and 2017. Despite frequently being represented as a law that ‘protects’ women, the study findings indicate that the criminalization of HIV non-disclosure constitutes a form of gendered structural violence that exacerbates risk for interpersonal violence among WLWH. In line with recommendations by, the WHO and UNAIDS these findings demonstrate the negative impacts of regulating HIV prevention through the use of criminal law for WLWH.
